01Who we are
These Terms & Conditions apply to the website mostros.co, to the goods sold under the MOSTROS name, and to the creative, design, film and technology services provided by MOSTROS ("MOSTROS", "we", "us"), a creative studio operating from Colombia and the United States. By using this website, sending us a brief or an inquiry, or buying our goods, you accept these terms. If you don't agree, please don't use the site.
02Services and proposals
Every project starts with a written proposal or quote that describes the scope, deliverables, timeline and price. A project begins when you accept it in writing (email counts) and we receive any agreed deposit.
If a separate signed contract exists for your project, that contract takes priority over these terms wherever they differ.
- Quotes are valid for 30 days unless stated otherwise.
- Work requested outside the agreed scope is quoted separately before we start it.
- Timelines depend on receiving your content, feedback and approvals on time. Delays on your side may move the delivery date.
03Fees and payment
- Unless the proposal says otherwise, projects require a 50% deposit to start and the balance before final files are delivered or a site goes live.
- Invoices are payable within 15 days in the currency stated on the invoice (USD or COP).
- Third-party costs such as hosting, domains, licences, stock media, fonts, plugins, talent or equipment rental are billed to you or paid by you directly.
- We may pause work on overdue accounts until payment is received.
04Revisions and approvals
Each proposal states the number of revision rounds included. Additional rounds, or changes after a phase has been approved, are billed at our current rate. Written approval of a phase (design, script, edit, build) means that phase is accepted.
05Intellectual property
- When the project is paid in full, you own the final deliverables created specifically for you, as described in the proposal.
- MOSTROS keeps ownership of its pre-existing tools, code libraries, templates, methods and unused concepts, and grants you a licence to use whatever is built into your deliverables.
- Third-party assets (fonts, stock, music, open-source software) stay under their own licences.
- Unless you ask us in writing not to, we may show the finished work in our portfolio, social media and awards submissions.
06Your materials
You confirm that you have the rights to any text, images, logos, footage, music or data you send us, and that using them in your project won't infringe anyone else's rights. You are responsible for the accuracy of your content and for legal review of claims made in it.
07Confidentiality
We keep your non-public business information confidential and use it only to deliver your project. This doesn't apply to information that is already public or that we are legally required to disclose.
08Cancellation
Either side may end a project with written notice. You pay for the work completed up to that date, plus any committed third-party costs. Deposits cover scheduled studio time and are non-refundable once work has started.
09Goods and orders
- Goods (apparel, stickers and other objects) are made in Colombia in limited runs. Colours on screen may differ slightly from the physical product.
- Orders are confirmed by message with the price, size and delivery cost before payment.
- Delivery times are estimates. Shipping outside Colombia may include customs duties paid by the buyer.
- If an item arrives damaged or with a manufacturing defect, tell us within 10 days of delivery with a photo and we'll replace or refund it. Worn, washed or custom items can't be returned for change of mind.
10Use of this website
All content on this website, including the MOSTROS name, mask logo, artwork, text, video and code, belongs to MOSTROS or its clients and may not be copied or reused without permission. Links to project sites and third-party platforms (YouTube, Instagram, Behance) are provided for convenience; we aren't responsible for their content.
11Privacy and your data
When you use our contact form or project brief, we collect what you type: name, email, phone, company, project details and budget range. We use it only to reply to you and prepare a proposal. Form submissions are stored in Google Workspace (Google Sheets via Google Apps Script).
- We don't sell or rent your data.
- We keep inquiries for up to 24 months unless we start working together, in which case project records are kept as long as the law requires.
- You can ask to see, correct or delete your data at any time by writing to info@mostros.co. Colombian users are covered by Ley 1581 de 2012 on personal data protection.
- The site loads fonts from Google Fonts, which may log your IP address. We don't use advertising trackers on this site.
12Liability
We deliver our services with professional care. To the extent the law allows, our total liability for any project is limited to the amount you paid for that project, and we aren't liable for indirect losses such as lost profits or data. We aren't responsible for outages or changes in third-party platforms (hosting, app stores, social networks, search engines), and no one can guarantee specific search rankings or sales results.
13Governing law and changes
These terms are governed by the laws of the Republic of Colombia, unless a signed contract chooses another jurisdiction. We'll try to resolve any disagreement by talking first. We may update these terms; the date below shows the latest version, and changes don't affect projects already accepted.
